Terms of Service

These Terms of Service govern your access to and use of Mixtape Monster, including our website, mobile app, and related services. By using Mixtape Monster, you agree to these terms and to our Privacy Policy (https://www.mixtapemonster.com/privacy).

If you do not agree, do not use the service.

You must be at least 13 years old to use Mixtape Monster. If you are under the age of majority where you live, you may use Mixtape Monster only with the permission of a parent or guardian.

You create a Mixtape Monster account by signing in with Spotify or YouTube (Google). You are responsible for activity under your account and for keeping your connected accounts secure. Tell us if you believe your account has been used without your permission.

If you disconnect Spotify or YouTube, sign out, or lose access to your Spotify or Google account, some Mixtape Monster features may not work until you reconnect. You can ask us to delete your account at any time as described in our Privacy Policy (https://www.mixtapemonster.com/privacy#delete-your-account).

Mixtape Monster uses the Spotify Platform for sign-in and playback. Playing full tracks requires a Spotify Premium account and the Spotify app, and is subject to the Spotify Terms of Use (https://www.spotify.com/legal/end-user-agreement/). Mixtape Monster is not affiliated with or endorsed by Spotify.

Mixtape Monster LLC, not Spotify, is responsible for Mixtape Monster. We make no warranties or representations on behalf of Spotify, and we disclaim on Spotify's behalf all implied warranties about the Spotify Platform, the Spotify service, and Spotify content, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

You may not modify or create derivative works based on the Spotify Platform, the Spotify service, or Spotify content, and you may not decompile, reverse-engineer, disassemble, or otherwise reduce them to source code.

Spotify and its content owners are not liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages arising from your use of Mixtape Monster.

Spotify music played through Mixtape Monster is for your personal, non-commercial use only. You may not broadcast it, play it in public or business settings, or mix, overlap, or remix Spotify audio.

Spotify is a third-party beneficiary of these Terms and of our Privacy Policy and may enforce them directly against you.

Mixtape Monster uses YouTube API Services for sign-in and to play YouTube videos. By using YouTube features in Mixtape Monster, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). Google's handling of your information is described in the Google Privacy Policy (https://policies.google.com/privacy). Mixtape Monster is not affiliated with or endorsed by YouTube or Google.

You may not misuse Mixtape Monster, interfere with how it operates, attempt unauthorized access, reverse engineer, decompile, or disassemble the app or any part of the service, scrape or abuse our APIs, use the service to break the law, or infringe the rights of others.

We may limit, suspend, or terminate access if we believe your use creates risk, violates these terms, or harms Mixtape Monster, users, partners, or third-party services.

Mixtape Monster and its design, trademarks, software, curation, and editorial content are owned by Mixtape Monster LLC or its licensors. These terms do not give you ownership of Mixtape Monster intellectual property.

Music, videos, images, artist names, and other third-party materials belong to their respective owners and may be subject to separate terms, including those of Spotify and YouTube.

We may update, add, remove, suspend, or discontinue features at any time. We work to keep the service reliable, but we do not guarantee that Mixtape Monster will always be available, uninterrupted, or error-free. Spotify and YouTube availability is controlled by those services, not by us.

Mixtape Monster is provided on an "as is" and "as available" basis. To the fullest extent allowed by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

To the fullest extent allowed by law, Mixtape Monster LLC and its affiliates, members, managers, employees, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from your use of Mixtape Monster.

You may stop using Mixtape Monster and ask us to delete your account at any time. We may suspend or terminate access if we believe you violated these terms, created risk, or used the service in a way that may harm users, partners, or Mixtape Monster.

These terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict-of-law rules.

Before filing a claim, you agree to contact us at darrell@concretekreative.com and try to resolve the dispute informally for at least 30 days. If it is not resolved, any dispute arising from these terms or your use of Mixtape Monster will be brought only in the state or federal courts located in Connecticut, and you and Mixtape Monster LLC consent to their jurisdiction. Nothing in this section limits rights you have under the consumer protection laws of the place where you live.

We may update these terms from time to time. When we make changes, we will update the date above and post the revised terms on this page. Continued use of Mixtape Monster after changes means you accept the updated terms.
